Child custody is one of the key issues that arises when couples separate or divorce. Ideally, the arrangements for children can be agreed between the parents and, if necessary, formally recorded. Unfortunately however, it is sometimes difficult for an agreement to be reached with regard to child custody and contact orders, and in these cases, many parents require legal help in order to resolve the issues.

Parental Responsibility
One of the most common enquiries received by Adams relates to Parental Responsibility, and fathers’ rights. Many parents believe that they have automatic equal rights in respect of their children. However, this is not necessarily the case. In law, all mothers have what is known as “parental responsibility” for their children, but the same does not apply to all fathers. This depends partly on marital status. So, whilst a married father has parental responsibility, unmarried fathers can only obtain parental responsibility if they are registered on the child's birth certificate as the birth father and the child was born after November 2003. Alternatively, they may able to enter into a formal agreement with the child's mother or by obtaining a Court order.
