The Employment Rights Act 1996, requires that all employees should receive a “written statement of particulars of employment” no later than two months after their employment starts. It is essential that you understand and respond to this area, and that you include in this statement key specific terms. These include
the names and details of the employer and the employee
the date when the employment began and, if different, when the period of
continuous employment began
details of pay – including methods of calculating pay and pay intervals – and
hours of work, holiday entitlements and details of sick pay
if appropriate, the pension scheme details
notice provisions and whether the employment is for a known duration fixed term
or not
job title or brief description of the work
details of the normal place of work and of requirements to work abroad
details of any collective agreements affecting the employment
details of grievance and disciplinary procedures or where these procedures can
be located .
It is also advisable to include a range of additional and more detailed information that goes beyond these statutory requirements, including for example, additional employee benefits, the length of a probationary period and the circumstances permitting the employer to terminate the contract on notice or without notice. These extra precautions can avoid costly and unpleasant disputes further down the line.
