What is Mediation?
Mediation is an informal process (with no wigs and gowns!) where parties get together with a neutral facilitator (the Mediator) and through a series of discussions and exchange of views, attempt to settle a pending Court dispute. The mediation takes place at an agreed venue and doesn’t involve the Court. The parties may attend with or without their legal representatives.
The Mediator is entirely neutral to both the parties and the case itself. Although normally an experienced lawyer, he or she is not there to make any judgments and rather acts as a facilitator attempting to find common ground in the conflict. The parties are able to explore the strengths and weaknesses of their case during private sessions with the Mediator.
The whole process is conducted on a “without prejudice basis” and this means that anything said by one party to the other cannot be repeated if the case subsequently goes to Trial. The parties are therefore free to express their views and ideas without fear of being “quoted”.
When an agreement is reached it is put into writing by the parties and then becomes binding and ends the Litigation.
What are the benefits of going to Mediation?
Mediation can happen very quickly (within days if required) and is enormously successful - the success rates exceed 80%.
Mediation is far less stressful than going to Court and is a fraction of the cost when compared to full scale litigation.
A Mediator can suggest solutions to a problem that a Court could never impose.
Mediation allows parties to ‘have their day in Court’ and express their point of view without going to Court.
